Official Rules

NO PURCHASE NECESSARY. THE FOLLOWING CONTEST IS INTENDED FOR RESIDENTS OF THE 50 UNITED STATES, INCLUDING THE DISTRICT OF COLUMBIA, WHO ARE 18 YEARS OF AGE OR OLDER, AND RESIDENTS OF CANADA, WHO ARE OVER THE AGE OF MAJORITY IN THEIR PROVINCE OF RESIDENCE. VOID WHERE PROHIBITED.

1. TO ENTER: You may enter by mail or on-line. Option 1: Access website www.sunkist.com and submit your Sunkist Smile original color photograph (photo size for digital camera pictures must be a minimum of 1,024 pixels x 768 pixels; photo size for scanned photos must be a minimum of 300 DPI at 3" x 5"; file size cannot exceed 500K and must be formatted as a .GIF, .JPG or .BMP file) of yourself or someone you know (any age) with a Sunkist® orange wedge in their mouth showing their Sunkist Smile. Enter the required information and follow the instructions on how to submit your entry. All on-line entries must be received between 12:01 A.M. (CST) on 3/1/03 and 11:59 P.M. (CST) on 4/30/03. Option 2: You can submit your entry by mail by completing the official entry form or hand writing on a 3" x 5" card, your full name, address, city, state/province, zip/postal code, daytime and evening phone number, age, e-mail address (optional) and an original color photograph (photo size anywhere from 3" x 5" to 8" x 10") of you or someone you know (any age) with a Sunkist® orange wedge in their mouth showing their Sunkist Smile. Mail entry, in an envelope bearing sufficient postage, to: Sunkist "Show Us Your Sunkist Smile™" Contest, P.O. Box 8215, Grand Rapids, MN 55745-8215 (USA). All mail-in entries must be postmarked by 4/30/03 and received by 5/9/03. Limit one entry per person/family/household. Only eligible entries actually received by Sponsor before the end of the specified entry period will be included in the Contest. All entries become the property of Sponsor and will not be returned. If required information is not completely filled out, your entry will be disqualified.
2. JUDGING: Entries will be judged based on the following criteria: 1) Creativity/Originality (40%); 2) Link to Sunkist brand character (wholesome, fun, energetic, upbeat) (40%) and 3) Quality of picture (clarity and composition) (20%). In the event of a tie, the winner will be determined by the Sponsor on the basis of its score for the first criteria, continuing thereafter to each additional criteria in numerical order as needed to break the tie.
3. PRIZE DETAILS: One (1) Grand Prize: Winner will receive a $10,000 check (USD), Family Circle Cookbook, one (1) year subscription to Family Circle Magazine; and winning photograph will be featured in a Sunkist ad in the September 2003 issue of Family Circle Magazine and on Sunkist packaging. (Approximate Retail Value "ARV": $10,060) (USD); Nine (9) Runner Up Prizes: A Digital Camera (Model # HP Q2171A), Family Circle Cookbook and one (1) year subscription to Family Circle Magazine (ARV: $287) (USD). In the case of unavailability of a prize, Sponsor, in its sole discretion reserves the right to substitute prize with similar prize of equal or greater value. Prizes are not transferable. Federal, state, provincial and local taxes, if any, are the sole responsibility of the winner. No substitutions or cash redemptions allowed by winner. Except as specifically provided herein, prize packages do not include any other items not specifically described in these Official Rules. Limit (1) one prize per person/family/household. All prizes will be delivered to confirmed winners.
4. ENTRY DETAILS: This is a skill contest. Entries must be of entrant's own creation, executed (including photograph) solely by the entrant, may not have been used to compete in any other photo competition, and must not be subject to or violate any rights of any other parties. Entries may not be offensive or defamatory, as determined by the judging panel in its sole discretion. Entries not complying with official contest requirements and/or those that are submitted by professional photographers will be subject to disqualification. Sponsor shall have the right to use, assign, or dispose of entries however it sees fit without the approval of entrants. By submitting entry, entrant warrants that photograph is original, has not been enhanced or retouched and that entrant is the sole copyright owner and that entry is not based upon or derived from a copyrighted work. By entering this contest, each entrant grants Sponsor the right to reproduce, publish, post photos on web-site or exhibit the photograph, in whole or in part, without charge or compensation. Sponsor reserves the right to select entries at random during the promotion period to post such entries on web-site. Being selected at random does not improve entrant's chances of winning. Person pictured in photo, if other than the entrant, may be of any age. If the photo contains likeness of any other person other than entrant, entrant must obtain permission from such person to submit his/her photo according to the Official Rules of this Contest. Entrants will also be required to obtain a signed perpetual royalty-free publicity release from any such person (and his/her parent or legal guardian if that person is a U.S. resident under the age of 18, or a Canadian resident under the age of majority in his/her province of residence), granting the Sponsor the right to use the photograph in accordance with the Official Rules of this Contest.
5. AWARDING OF PRIZE: On or about 12:00 PM (CST) on 5/14/03, an independent judging agency located in Grand Rapids, MN (USA), will judge and select all winners from among all qualified entries received. Decisions of the judging panel are final on all matters relating to compliance with the contest rules, eligibility, and selection of winners, and are not subject to challenge. If a selected winner entered the contest on-line, the prize will be awarded to the authorized account holder of the submitted Internet e-mail address, if selected, regardless of the individual who submitted the entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet Service Provider or other organization that is responsible for assigning e-mail addresses or the domain names associated with e-mail addresses. Potential grand prize and runner-up winners will be required to complete and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of date notice sent or prize will be forfeited and may be awarded to an alternate winner. If any prize or prize notification is returned as undeliverable, prize will be forfeited and an alternate winner selected. By accepting a prize, participants consent to use of their name, photograph, likeness, biographical information and address (city & state/province only) and submitted photo entry in any form for advertising or publicity purposes without further compensation, payment or credit for use of photo, except where prohibited by law. All prizes to be awarded by 7/15/03.
6. ELIGIBILITY: Contest open to individuals, who are legal residents of the 50 United States, including the District of Columbia, who are 18 years of age or older, or who are legal residents of Canada, who are over the age of majority in their province of residence. Employees, and those living with employees, of Sunkist Growers, Inc. ("Sponsor"), Gruner + Jahr, USA, and their affiliate companies, subsidiaries, advertising and promotion agencies (collectively, "Sponsor Affiliates"), and their family members are not eligible to enter or win. Professional photographers are also ineligible to participate in this Contest.
7. GENERAL CONDITIONS: It is your responsibility to ensure that you have complied with all of the conditions contained in the Official Rules. Sponsor and Sponsor Affiliates are not responsible for late, lost, destroyed, postage due or wrongly addressed mail in connection with this Contest. Sponsor and Sponsor Affiliates are not responsible for any lost, late, incorrect, or inaccurate information, downloading of entries or entries that are misdirected or misrouted as a result of interrupted or unavailable network connections or Internet transmissions for any reason, or for any computer, phone, phone line hardware or software malfunction, failure or error of any kind, whether mechanical, human or electronic, or incomplete or unusable uploads. Sponsor and Sponsor Affiliates are not responsible for any injuries, damages or losses which may be sustained in connection with this Contest and/or the ownership, use or misuse of the prize. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest, or the on-line portion of the Contest, and select winners from among all eligible entries received prior to the cancellation. Persons found tampering with or abusing any aspect of this Contest, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. As a condition of entering this Contest, participant agrees that: (1) under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (4) participant shall be bound by these Official Rules.
